That price tag is still rising as Kroger defends itself in a lawsuit brought by Albertsons that aims to collect on the $600 million termination clause in the contract between the two grocery giants.

The wholesaler is not entitled to a $125 million merger termination fee because of several contract breaches, Kroger said in a legal filing.
